A BILL to amend article two, chapter twenty-seven of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
one-b, relating to authorizing the department of health and
human resources to lease or convey the Greenbrier college
for women property.
Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty-seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section one-
b, to read as follows:
ARTICLE 2. MENTAL HEALTH FACILITIES.
§27-2-1b. Department authorized to lease or convey Greenbrier
College for Women property.
On and after the effective date of this section the
department of health and human resources is authorized to enterinto a lease or conveyance agreement with the Bluefield State
College Foundation, Inc. a nonprofit, nonstock corporation,
chartered as a corporation under the laws of this state on the
sixth day of February, one thousand nine hundred sixty-nine.
Under the terms of such agreement, the department of health and
human resources may lease or convey to the Bluefield State
College Foundation, Inc., all or a portion of the property
formerly owned by the Greenbrier College Corporation and
described in a deed dated May 31, 1973, from Greenbrier College
Corporation unto the state of West Virginia, the department of
health as set out in Deed Book 280, at page 31. Such agreement
shall require that the Bluefield State College Foundation, Inc.,
perpetuate the use of the property known as the Greenbrier
Center, primarily for the educational and recreational purposes
which will benefit the citizens of the Greenbrier Valley and the
state of West Virginia. The lease of the premises may be for a
nominal fee of one dollar and for such terms as the department
deems appropriate and for so long as the Bluefield State
Foundation, Inc., uses the premises for the purposes set forth in
its original charter described above, and as a nonprofit,
nonstock corporation. To accomplish the purposes outlined
herein, the Bluefield State College Foundation, Inc. may sublet
to any public or private entity all or a part of the property.
NOTE: This bill authorizes the Department of Health and
Human Resources to lease or convey to the Bluefield State College
Foundation, Inc. the property known as the Greenbrier Center.
